Major Contract Violations/Issues by Aces Roofing Inc. of Watkins, CO:
The contractor misrepresented his contractor registration status (his last registration expired over 10 years ago) with Adams Co and never pulled a permit. Upon learning this, I pulled the permit myself. (Exhibit A)
Brought a trailer half-filled with trash and stored it on my driveway. My request to get it off my driveway was met with “I have no other place to put it, other than perhaps your back yard. But don’t worry, I will not overfill it the way we did the first one, so your cement will not suffer damage.” More debris was added over the next couple of days, but the trailer remained on my driveway for several more days after all tear off work had already seized. The trailer was filled to the rim, despite promises to the contrary. Promised every day to take it away “tomorrow,” but “tomorrow” only came more than a week later. The trash I had sitting in front of the house, which the Contractor promised in the contract to haul away was left behind. In fact more was added to it. (Exhibit B1 and B2)
The work site was never cleaned up, debris, cigarette buts, nails and other sharp objects were left behind. One of the employees told me that they no longer had the magnet. Every day I picked up after the workers, collecting nails and shingles all around the house. One of the latest “crops” was gathered without use of magnets or special tools on 10/7. (Exhibit C)
Front porch bow was not properly corrected. In place of the slight bow 1” over 12’, there are now multiple valleys and ridges, none of which where there before. I mentioned to the foreman this before they started shingling, but he said it was done with a chalk line and is perfectly straight. I repeated that there was an obvious problem after some shingles were already placed in the area, but my complaint was ignored. Contractor attempted to fix this problem afterwards by adding shingles underneath promising to make it look absolutely even once he was done. After 4 attempts by the foreman to add and remove shingles in that area, it only looks worse and shingles there have been abused in the process. (Exhibit D)
Broke a piece of the trim in the rear of the house and attempted to reattach the broken piece with caulk. This trim piece must be remade. (Exhibit E)
The contract called for reattaching all lose fascia boards, as required. This was not properly done and a large gap was created through which insects can easily get in to nest. (Exhibit F1 and F2)
Installed top of fascia ½” higher than the deck level – this is a major problem for at least two reasons: 1. This reduces roof’s resistance to wind, which was a major reason for upgrading to much more expensive shingles in the first place and 2. This creates a pocket for moisture to gather in the area between the top of the fascia and the decking, especially because 1” x 2” metal was used, instead of the shingle manufacturer specified 2” x 2” metal. The contractor attempted to remedy the cosmetics of this situation by “feathering out” (adding shingles under the ones at the edge of the roof to make an appearance of a smaller transition). This does not solve either of the problems but makes the problem more difficult to see. In addition used screws of wrong type were used for attaching the fascia.
Broke one of the new fascia boards during reinstallation and did not properly fix it. (Exhibit G)
Nailed lightning rod wires on the side of the roof, instead of screwing them into the new fascia board, as I had requested and which method was used prior to the contractor replacing those fascia boards. This installation method is not approved by the manufacturer and violates local building code, as it causes face nailing of the shingles.
Installed one of the soffit vents crooked, outside the house wall perimeter and under the downspout. This is not proper installation; it does not allow for proper venting of the attic and may allow excessive moisture to enter through this vent.
Did not pick up and deliver the trim, as was agreed to in the contract.
Marked locations and prepared to install, but never completed the installation of sky tubes. (Installation of the second sky tube along with the cost of $75 was added to the contract within a week after the original contract was signed.) (Exhibit H1 and H2)
Used the wrong caulk (Alexis Plus) – not what was specified in the contract (elastometric).
Did not electrically connect attic fans.
Did no work at all on the second building.
Destroyed my lawn grass, peonies and many other flowers. (Exhibit I)
Created a nightmare for me and major problems for everyone else that needed to work on the house by never following the agreed upon schedule. The painter and the gutter installer had to come out extra times. Internet provider had to reschedule twice. All other projects inside the house had to be put on hold and delayed, greenhouse plans were destroyed completely. I could not do any of my own work while attempting to mitigate and manage this disaster. My almost six month pregnant wife had a nervous breakdown as a result of all this…
